The Russian criminal prosecution system does not have
backstop. Termination of the case on rehabilitative grounds
or acquittal in court occurs in less than 1% of cases , and
the system perceives these cases as marriage. Over 90% of criminal cases going to court contain a confession, and about three quarters
Cases are dealt with in a special manner - with and without admission of guilt.
Such a number of confessions does not arise from scratch:
psychological and physical pressure is exerted on the accused.
At least 80% of criminal cases work appointed lawyers, provided by the state. Among such defenders often there are so-called “pocket lawyers” who actually take the side of the charge.
In cases involving state secrets, accusatory bias criminal prosecution systems compounded by secrecy and fear. The investigation is conducted by the Federal Security Service (FSB).
Case files are classified, sometimes accusations are built on violation of secret norms that cannot be read even the accused. Courts consider such cases behind closed doors: neither relatives nor human rights defenders nor journalists. The accused is placed in Lefortovo or similar close FSB isolation ward, where the accused is cut off from the outside world, and relatives are scared of criminal cases for divulging state secrets. When an independent lawyer gets into a state secret case, often he finds out that the investigation and the court are in violation, while the allegations are far-fetched. But most of these cases do not get wide publicity. With this report, Team 29 partially corrects the situation.
Because investigators, prosecutors, and judges tend to refuse
comment on such cases and try to hide violations of the law,
the report is more based on the evidence of lawyers,
human rights defenders and journalists.

Key points
To prepare the report, Team 29 investigated the judicial
statistics and practice in cases of high treason, espionage, disclosure
state secrets for 1997-2017. We relied on the data of the Judicial
Department of the Supreme Court, examined more than 300 publications
in the media, more than 50 case cards on the sites of regional, provincial and district courts, the website of the Supreme Court and in the GAS "Justice" system, took 22 interviews with prisoners, their relatives and lawyers.
Since 1997, when the new Criminal Code was introduced in Russia,
for treason (Article 275 of the Criminal Code) and espionage (Article 276 of the Criminal Code) were convicted 100 people (96 according to the Judicial Department, 101 according to the media and other open sources). These numbers are several times smaller than those what President Vladimir Putin calls. This is our common holy duty.
